Can my attorney withdraw money from my account at an ATM?
Answered by the SAMEDAY LPA team — qualified estate planner
Practically, no. Attorneys cannot use the donor's bank card or PIN to access an account — even with a valid registered LPA. The proper process is to present the registered LPA to the bank, get themselves added as an attorney on the account, and use their own banking access to manage it. Some banks issue attorneys their own debit card with their own PIN linked to the donor's account. Using the donor's own card and PIN is fraud, even with the best intentions. We include guidance on this in every attorney pack — it's the kind of practical detail most providers leave out.
