Only in limited circumstances and only if it's something you'd have done yourself. The legal test is that the gift must be reasonable in the circumstances and consistent with your past pattern of giving. Small gifts to family on customary occasions (birthdays, weddings) and modest charitable donations you regularly made are usually fine. Anything beyond that requires Court of Protection approval. The Office of the Public Guardian publishes guidance on gifts and it's worth your attorneys reading it before they make any non-routine gift. We include a copy of this guidance in the attorney pack we send with every LPA.
