Can my attorney sell my house under a Property and Financial Affairs LPA?
Answered by the SAMEDAY LPA team — qualified estate planner
Yes, if you've given them that authority. Selling your house counts as managing your property and financial affairs, so it's within the powers of a registered Property and Financial Affairs LPA. There are two caveats worth knowing. First, they must act in your best interests at all times — they can't sell it to themselves for less than market value, for example. Second, if you've added a restriction in section 7 of the form (for instance, "my attorneys may not sell my home without my consent"), they must follow it. Most people don't add restrictions, but you can.
