My partner has just had a stroke and can't communicate clearly — is it too late?
Answered by the SAMEDAY LPA team — qualified estate planner
The honest answer is: maybe, maybe not. The question is whether they currently have the mental capacity to make an LPA — to understand who they'd appoint, what powers those attorneys would have, and to choose to make it. Capacity can fluctuate, especially in the early days after a stroke. If there are moments when they're alert and able to communicate clearly (even if speech is limited — we can work with yes/no answers, writing, or simple gestures if necessary), it may be possible. Call us today. We can do a same-day assessment with a qualified planner and a professional Certificate Provider. If we don't think capacity is there, we'll tell you and explain the Court of Protection alternative.
